DUI In Riverside, CA?
My brother got pulled over because he was diving a car that matched the description of a robbery suspect. After making him back out of the car with their guns drawn, go to his knees, etc. They realized he was not the suspect but he had been drinking. They gave him a field test, decided to take him in. He was told at the jail that the breathalyzer was not working so he did a blood test. I do not know the results of the test. He is over 21, has no priors for anything, was not speeding, swerving, Etc. Just in the wrong place at the wrong time, and yes, HE PROBABLY SHOULD NOT HAVE BEEN DRIVING. So my question is, what is he looking at as far as jail, fines, etc. Does he have any viable defense for probable cause? I hope to hear from knowledgeable lawyers, LEO’s, and people with similar situations. I know I will hear from other trolls, and they are always funny to read too, so knock yourself out trolls!

The police had probable cause to stop him, just because he was not the suspect, they had a right to stop him thinking he was. Police make up reasons to stop you when they have no probable cause. Sounds like they really thought it might be their man. As far as a real defense goes? Well depends on how much money he has really. A good lawyer is paramount. If the charge goes through he will:
Have his license suspended for at least 90 days.
Pay a huge fine (and CA has some lou-lous)
His insurance will go up for 3 years as an SR-22 (Severe Risk)
He will have to pay a yearly fine to the state for 3 years to maintain the record.
AND last but not least some employers look at a driving record for job candidates. That does not stop at 3 years, it stays on his record for 10 years. I know I won’t hire someone for ANY job with a prior DUI. It shows very poor judgment and lack of personal control.
A lawyer can make it go away if it is a first offense. But its going to cost about $5000 for a really good one. So how much money does he have right this minute? How much will it cost in the long run?
