What are the child custody laws in San Antonio Texas?
I am planning to get a divorce from my husband of 16 years because of consistent infidelities. I have been a stay at home mom all these years. My boys are 9 and 12. He demands to have joint custody and I would like him to have them every other weekend. He’s not a great father and does not know how to take care of them. I have done everything for them. He doesn’t cook, clean, doctors appointments, nothing. He only plays with them and disciplines them randomly. He’s all about his career and himself. I am looking for a job now so that I can support myself and the kids. I don’t have money for a lawyer either my family is not helping me at all. They want me to get a divorce, but they aren’t offering me any help at all. A temporary place to stay or money for a lawyer. Any help at all in this matter would be greatly appreciated. Also, I have called several agencies that offer free legal support here, but I can’t get further than an answering machine.
Unfortunately, you are going to have to get a lawyer, I know you can’t afford one right now, but there are lawyers out there that will take you case and get paid monthly rather than an up front retainer.
Your first step is get a lawyer. Then you want to ask for the house, for the husband to pay for the house while you are working through divorce, primary custody of the kids, spousal support, child support, and a car.
You have been the homemaker and are therefor by default the caretaker of the children, he will not get primary custody, but he will get joint custody and have them every other weekend and alternating holidays. Since you have been the homemaker the law sees your husbands job as your job too, because without the supporting home structure you provide he would not be able to have that kind of a job, and therefor you are entitled to a good portion of the salary. The lawyer can be paid in spousal support monthly. Get one of your husbands pay check stubs, you will need this to help you file for everything.
